These Terms of Service (“Terms”) apply to all bookings, hires, and services provided by Down Memory Lane (“we”, “us”, “our”).

By making a booking or using our services, you agree to these Terms.

1. Our Service

Down Memory Lane provides camcorder hire and optional editing services designed to capture candid, authentic moments from your event.

Our service is intended to complement the natural atmosphere of your celebration and is different from traditional videography services.

Because footage is captured by guests and loved ones, we cannot guarantee:

  • Specific moments will be captured

  • Professional audio quality

  • Perfect framing, lighting, or stability

  • Continuous recording throughout the event

Every wedding and event is unique, and final footage will naturally reflect the people, environment, and moments captured on the day.

2. Booking & Payment

All bookings are date-specific and subject to availability.

Booking process

To secure your date, the following process applies:

  • You enquire and we confirm availability for your selected date

  • Once availability is confirmed, your chosen date and equipment will be placed on hold for 48 hours

  • During this 48-hour hold period, full payment is required to confirm your booking

  • If payment is not received within 48 hours, the hold will be released and the date/equipment will become available for other bookings

Confirmation

Your booking is only confirmed once:

  • Full payment has been received, and

  • You have received written confirmation from Down Memory Lane

Payment

Full payment is required to secure all bookings.

3. Cancellations & Refunds

Deposits are non-refundable, as your booking date is reserved exclusively for you.

Refunds will generally not be provided for:

  • Change of mind

  • Missed footage or moments

  • Personal preferences relating to filming style

  • Courier delays outside our control

  • Weather or unforeseen event conditions

  • Variations in footage quality resulting from guest filming

If cancellation occurs after equipment has been dispatched, the full booking amount may still apply.

Nothing in these Terms limits your rights under the Consumer Guarantees Act 1993 where applicable.

4. Shipping & Delivery

Equipment is shipped using trusted third-party courier services.

While we do our best to ensure timely delivery, we cannot guarantee courier delivery timeframes and are not responsible for delays caused by:

  • Weather events

  • Public holidays

  • Courier disruptions or backlogs

  • Incorrect delivery details supplied by the customer

Responsibility for the equipment passes to you once delivery has been confirmed by the courier provider.

5. Equipment Care & Responsibility

Customers agree to:

  • Use equipment responsibly and with reasonable care

  • Follow all instructions provided

  • Keep equipment safe and secure during the hire period

  • Return all equipment by the agreed return date

Equipment must not be:

  • Submerged in water

  • Exposed to excessive sand, saltwater, smoke, or extreme conditions

  • Tampered with, modified, or repaired

Customers are responsible for any loss, theft, or damage beyond normal wear and tear during the hire period.

Where applicable, repair or replacement costs may be charged.

6. Late Returns & Non-Returned Equipment

All equipment must be returned using the supplied return packaging and courier instructions by the agreed return date.

Late returns may incur a late fee of $50 NZD per day, per camcorder.

If equipment is not returned within 7 days of the agreed return date, it may be considered lost and replacement costs may apply.

Editing services will not begin until all equipment has been returned.

7. Editing & Final Delivery

Editing begins once all equipment has been returned.

Delivery timeframes are estimates only and may vary during busy periods.

Our editing style is part of the Down Memory Lane experience and examples of our work are available on our website and social media.

By booking with us, you acknowledge and accept our editing style.

We do not offer revisions based on:

  • Personal taste

  • Requests to recreate another creator’s style

  • Requests to include specific moments not captured

However, we are happy to correct factual or technical errors where appropriate.

8. External Footage

To maintain consistency and quality, we only edit footage captured using Down Memory Lane equipment unless agreed otherwise in writing.

This helps preserve the candid camcorder look and experience our service is built around.

9. Marketing & Social Media Use

Unless you choose to opt out in writing before your event, you grant Down Memory Lane permission to use selected footage, stills, or edited clips for marketing and promotional purposes. This may include use on our website, social media platforms, advertising, and portfolio content.

We will never sell your footage or use full raw footage in marketing materials.

If you opt out of marketing use, we will respect your request and exclude your content from promotional use.

10. Technical Issues & Force Majeure

We are not liable for delays, interruptions, or losses caused by circumstances outside our reasonable control, including:

  • Severe weather

  • Natural disasters

  • Courier disruptions

  • Equipment malfunction

  • Power outages

  • Data corruption

Where liability applies, it will be limited to the amount paid for the affected booking.

11. Intellectual Property

All Down Memory Lane branding, website content, edited videos, graphics, and creative materials remain the intellectual property of Down Memory Lane unless otherwise agreed in writing.

Content may not be copied, reproduced, resold, or used commercially without written permission.

12. Consumer Guarantees Act

Nothing in these Terms is intended to exclude or limit any rights you may have under the Consumer Guarantees Act 1993 or other applicable New Zealand consumer laws.

Where services are acquired for business purposes, the Consumer Guarantees Act may not apply.

13. Changes to These Terms

We may update these Terms from time to time.

The latest version will always be available on our website.
